Content is:<\/p>

(a) all forms of information, including text, pictures, animations, video, sound recordings, software, separately or combined, and<\/p>

(b) any content<\/em> service<\/p>

that is sent and\/or received across a network.<\/em><\/p><\/td><\/tr>

credit rating<\/em><\/strong><\/td>Information about your <\/em>credit worthiness, credit history or credit capacity that credit providers are entitled to give each other under the Privacy Act 1988<\/em> (Cth).<\/td><\/tr>
Credit Reporting(or CRB)<\/em><\/strong><\/td>An organisation whose business involves handling personal information in order to provide another entity with information about the credit worthiness of an individual.<\/td><\/tr>
Critical Information Summary(or CIS)<\/em><\/strong><\/td>A summary of the main features of the agreement, like what you will pay and what you will get.<\/td><\/tr>
current<\/em><\/strong><\/td>Available at the time.<\/td><\/tr>
data allowance<\/em><\/strong><\/td>The amount of maximum data usage <\/em>that can be used in a given month as set out in your pricing plan. Data allowance <\/em>is measured in Kilobytes (Kb). For our mobile<\/em> products and services<\/em> 1MB = 1024Kb.<\/td><\/tr>
data usage<\/em><\/strong><\/td>The amount of data that you have uploaded<\/em> and downloaded<\/em> in a given month, measured in MB.<\/td><\/tr>

Premium Service<\/em><\/strong><\/td>Services beginning with ’19’ delivering news, financial data, weather information, horoscopes, mobile ringtones, adult services, games, competitions, chat and other content, to mobile phones.<\/td><\/tr>
Product Repayment Plan<\/i><\/b><\/td>Any Product Repayment Plan described in Appendix Q<\/td><\/tr>
equipment owned by us<\/em><\/strong><\/td>Any equipment we<\/em>, or our<\/em> personnel<\/em>, may provide to you<\/em> to use in connection with the service<\/em> that is owned by us<\/td><\/tr>
excluded event<\/em><\/strong><\/td>

Fair Use Policy<\/em><\/strong><\/td>The eephone Fair Use Policy as set out in Appendix A.<\/td><\/tr>
Fair Terms<\/em><\/strong><\/td>Has the meaning given by clause 3.4 of the general terms.<\/td><\/tr>
fixed-length agreement<\/em><\/strong><\/td>An\u00a0agreement<\/i>\u00a0that has a\u00a0minimum<\/i>\u00a0fixed<\/i>\u00a0term<\/i>, during which time neither\u00a0you<\/i>\u00a0nor\u00a0we<\/i>\u00a0are free to change the terms of the\u00a0agreement<\/i>\u00a0or to\u00a0cancel the service<\/i>, other than as expressly permitted under the\u00a0agreement<\/i>. A month-to-month\u00a0agreement<\/i>\u00a0is not a\u00a0fixed-length<\/i>\u00a0agreement.<\/i><\/td><\/tr>
flagfall<\/em><\/strong><\/td>Has the same meaning as means connection<\/em> fee<\/td><\/tr>

HSPA<\/em><\/strong><\/td>High-Speed Packet Access, which is 3G mobile telephone protocol which provides for UMTS based networks <\/em>to increase their data speeds and capacity.<\/td><\/tr>
IMEI blocking<\/em><\/strong><\/td>Where your<\/em> mobile phone or modem is blocked from being used for communication<\/td><\/tr>
Insolvency event<\/em><\/strong><\/td>

Is when:<\/p>

(a)\u00a0\u00a0\u00a0 bankruptcy proceedings are commenced against you<\/em>, or you<\/em> are declared bankrupt; or<\/p>

(b)\u00a0\u00a0\u00a0 any step is taken to enter into any scheme of arrangement between you<\/em> and your<\/em> creditors; or<\/p>

(c)\u00a0\u00a0\u00a0 any step is taken by a mortgagee to enter into possession or dispose of the whole or any part of your<\/em> assets or business; or<\/p>

(d)\u00a0\u00a0\u00a0 any step is taken to appoint a receiver, a receiver and manager, a trustee in bankruptcy, a liquidator, a provisional liquidator, and administrator or other like person to you<\/em> or to the whole or any part of your<\/em> assets or business; or<\/p>

(e)\u00a0\u00a0\u00a0 you<\/em> suspend payment of your debts generally; or<\/p>

(f)\u00a0\u00a0\u00a0\u00a0\u00a0 you are<\/em>, or become, unable to pay your<\/em> debts when they are due or you<\/em> are, or are presumed to be, insolvent for the purposes of any provision of the Corporations Act 2001 (Cth)<\/em>.<\/p><\/td><\/tr>

Intellectual Property Rights<\/em><\/strong><\/td>Any intellectual property rights (including any registered or unregistered trademarks, patents, designs, or copyright) anywhere in the world<\/td><\/tr>

notice in writing<\/em><\/strong><\/td>Giving notice to you<\/em> in person, sending it to you<\/em> by mail or to your<\/em> email address by bill message or bill insert and informing you of how to obtain information about the change<\/td><\/tr>
non fixed-length agreement<\/em><\/strong><\/td>An agreement<\/em> that does not have a minimum<\/em> term<\/em>, or a fixed-length agreement<\/em> where the minimum<\/em> term<\/em> has expired. A month-to-month agreement is a non fixed-length agreement<\/em>.<\/td><\/tr>
Numbering regulations<\/em><\/strong><\/td>The Australian Communication and Media Authority\u2019s Numbering Plan and Telecommunications Numbering Plan Number Declarations.<\/td><\/tr>
our network<\/em><\/strong><\/td>The network<\/em> which we use to supply the service<\/em> to you<\/em>, whether the network<\/em> is owned and operated by us or by any supplier<\/em> to us<\/td><\/tr>
personal information<\/em><\/strong><\/td>Information about you from which your identity is app<\/td><\/tr>
personnel<\/em><\/strong><\/td>A party\u2019s employees, agents, contractors or other representatives.<\/td><\/tr>
phone number<\/em><\/strong><\/td>The phone number you<\/em> choose to use for the service<\/em>, or which we select and issue to you<\/em> in accordance with the Numbering Regulations.<\/em><\/td><\/tr>
premises<\/em><\/strong><\/td>

  1. at which\u00a0we\u00a0<\/i>supply the\u00a0service;\u00a0<\/i>and\/or<\/li>
  2. to which\u00a0we\u00a0<\/i>need to have access to supply the\u00a0service.<\/i><\/li><\/ol><\/td><\/tr>
pricing plan<\/em><\/strong><\/td>The part of the agreement<\/em> titled pricing<\/em> plan<\/em> as set out in the pricing tables.<\/td><\/tr>
pricing table<\/em><\/strong><\/td>The part of the agreement<\/em> titled pricing<\/em> table.<\/em><\/td><\/tr>
port<\/em><\/strong><\/td>To transfer your phone number <\/em>from one carrier <\/em>or carriage service provider <\/em>to another carriage or carriage service provider <\/em>in respect of your service.<\/em><\/td><\/tr>
port authorisation form<\/em><\/strong><\/td>Is the form that we<\/em> use that is required to be completed for your phone number<\/em> to be ported.<\/td><\/tr>
regulator<\/em><\/strong><\/td>Any of the following: the Australian Communications and Media Authority, the Australian Competition and Consumer Commission, the Australian Communications Industry Forum Limited, the Telecommunications Industry Ombudsman; any other applicable government or statutory body or authority.<\/td><\/tr>
related corporation<\/em><\/strong><\/td>Has the meaning given to that term in section 50 of the Corporations Act 2001 (Cth).<\/em><\/td><\/tr>
relevant advertising material<\/em><\/strong><\/td>Any current brochure, customer guide or pricing guide published from time to time by us in connection with the service.<\/em><\/td><\/tr>
secondary contact<\/em><\/strong><\/td>Another person nominated and authorised by you<\/em> to receive access to and operate your<\/em> \u8d26\u6237<\/em> on your<\/em> behalf in accordance with the agreement<\/em>.<\/td><\/tr>
service<\/em><\/strong><\/td>The service<\/em> specified in the application<\/em> and described in the service<\/em> description<\/em> and any related goods or equipment and ancillary services that we supply to you in connection with that service<\/em>.<\/td><\/tr>
service description<\/em><\/strong><\/td>The part of the agreement<\/em> titled service<\/em> description<\/em>.<\/td><\/tr>
service start date<\/em><\/strong><\/td>The date on which we <\/em>start supplying that service to you, <\/em>unless otherwise specified in the service description. <\/em><\/td><\/tr>
SIM card<\/em><\/strong><\/td>A subscriber identity module (SIM) card.<\/td><\/tr>
special<\/em><\/strong><\/td>A special promotion or offer made by us<\/em> in respect of the service<\/em>.<\/td><\/tr>
supplier<\/em><\/strong><\/td>The supplier of goods or services which are used directly or indirectly by us<\/em> to supply the service to you<\/em>, including any supplier<\/em> of a network<\/em> to us<\/em>.<\/td><\/tr>
tax <\/em><\/strong><\/td>Any value-added or goods and service tax, withholding tax, charge (and associated penalty or interest), rate, duty or impost imposed by any authority, excluding any income tax or capital gains tax.<\/td><\/tr>
Telecommunications Legislation<\/em><\/strong><\/td>Includes the following: the Telecommunication Act 1997 (Cth)<\/em>, the Telecommunications (Consumer Protection and Service Standards) Act 1999 (Cth) <\/em>and Part XIB, Part XIC and related provision of the Trade Practices Act and Competition and Consumer Act<\/em>, including the Australian Consumer Law.<\/em><\/td><\/tr>
Third party<\/em><\/strong><\/td>Any party who is not a party to the agreement<\/em>.<\/td><\/tr>
Third party content<\/em><\/strong><\/td>Any content<\/em> provided by a third party<\/em>.<\/td><\/tr>
Trade Practices Act<\/em><\/strong><\/td>The Trade Practices Act 1974<\/em> (Cth).<\/td><\/tr>
value added features, value added service features, value added service<\/em><\/strong><\/td>Additional features you<\/em> may obtain with the service<\/em>. The value added service features<\/em> available with the service<\/em> and the associated fees and charges are described in the value added services table<\/em> in Appendix P<\/td><\/tr>
We<\/em><\/strong><\/td>eephone (and us<\/em><\/strong> and ours<\/em><\/strong> is to be construed accordingly)<\/td><\/tr>
You<\/em><\/strong><\/td>
    1. The person who completes the application;<\/li>
    2. The person on whose behalf the Application is completed; and<\/li>
    3. The person to whom the service is provided<\/li><\/ol><\/li><\/ol>

      (and you and yours have corresponding meanings).<\/p><\/td><\/tr>

\u00a0<\/strong><\/p>

INTERPRETATION<\/strong><\/p>

(a)\u00a0\u00a0\u00a0 The following words have the same meaning in the agreement<\/em> as they have in the Telecommunications Legislation<\/em>:<\/p>

(i)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 carriage service,<\/p>

(ii)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 carriage service provider,<\/p>

(iii)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 carrier,<\/p>

(iv)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 content service<\/em>, and<\/p>

(v)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 facility.<\/p>

(b)\u00a0\u00a0\u00a0 Where a term is defined in part of the agreement<\/em> that term has the same meaning in all parts of the agreement.<\/em><\/p>

(c)\u00a0\u00a0\u00a0 The singular includes the plural and vice versa.<\/p>

(d)\u00a0\u00a0\u00a0 The word \u2018including\u2019 does not limit what else might be included.<\/p>

(e)\u00a0\u00a0\u00a0 A reference to an Act, code or includes a reference to any regulations or other statutory instruments made under that Act, code or law and any consolidations, amendments, re-enactments or replacements of that Act, code or law.<\/p>

(f)\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong>A reference to $ or payment is a reference to Australian dollars and payment in Australian dollars.<\/p>

(g) Nothing in the Agreement shall be interpreted against the interest of eephone Telco Pty Ltd t\/as eephone only because eephone relies on it or was responsible for drawing it.<\/p>
